Terms of Service
1. Acceptance of Terms
By creating an account or using BrainWave ("the Service"), you agree to these Terms of Service. If you are registering on behalf of a school or organization, you represent that you have authority to bind that organization.
2. The Service
BrainWave provides AI-powered tutoring services for students aged 5–18. The Service includes student AI tutoring, parent/teacher dashboards, progress tracking, and administrative tools.
BrainWave is an AI tutoring assistant. It is not a replacement for qualified educators and should be used as a supplementary learning tool.
3. Accounts & Eligibility
- School accounts must be created by an authorized school administrator (18+)
- Family accounts must be created by a parent or guardian (18+)
- Children under 13 may only use BrainWave through a parent/guardian account with explicit consent
- You are responsible for maintaining the security of your account credentials
4. Free Trial
New accounts receive a 30-minute free trial with full access to all features. After the trial expires, a paid subscription is required to continue using the Service. Trial accounts are limited to one per person/school.
5. Payments & Subscriptions
- Payments are processed securely by PayPal
- School plans are billed monthly or weekly per the selected plan
- Family plans are billed weekly or annually per the selected plan
- Subscriptions auto-renew unless cancelled before the renewal date
- Refunds are available within 7 days of payment for first-time subscribers
- To cancel, contact billing@brainwave.school
6. Acceptable Use
You agree NOT to:
- Use the Service to generate harmful, offensive, or inappropriate content
- Attempt to bypass the AI safety filters
- Share account credentials with unauthorized users
- Use the Service for any commercial purpose other than as intended
- Attempt to reverse-engineer or scrape the Service
- Use the Service to violate any applicable law
7. AI Limitations & Disclaimer
BrainWave's AI tutor strives for accuracy but may occasionally make mistakes. We recommend:
- Verifying important information with teachers or other sources
- Not relying solely on BrainWave for exam preparation
- Reporting any concerning AI responses to safety@brainwave.school
BrainWave is not liable for academic outcomes resulting from use of the Service.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Termination
We may suspend or terminate accounts that violate these Terms. You may cancel your account at any time by contacting hello@brainwave.school.
10. Limitation of Liability
To the maximum extent permitted by law, BrainWave shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
11. Changes to Terms
We may update these Terms. We'll notify you by email at least 14 days before material changes take effect. Continued use after changes constitutes acceptance.
